Purpose

The purpose of this Privacy Policy is to describe how Praecipio Consulting LLC, and our online affiliates collect, use, and share information about you through our website (https://www.praecipio.com/) owned and controlled by us (referred to herein as the “Site”), and through any other medium you use to communicate with us.

The creation of this Privacy Policy stems from our fundamental respect for your right to privacy and will serve to guide our relationship with you. We value the privacy and security of your “personal information,” which as used herein means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household. As such, we take complying with data privacy and security laws very seriously.

Scope; Third-Party Sites

This Privacy Policy applies to information we collect at and through the Site and to information you provide us through any other medium, including, for example, email, text messages, telephone, letters, or otherwise. Our Site also contains links to third-party sites that are not owned or controlled by us. Please be aware that we are not responsible for the privacy practices of such other sites. We encourage you to be aware when you leave our Site and to read the privacy statements of each and every website that collects personal information.


Information We Collect and Why We Collect It

Information You Provide to Us

Personal data may be freely provided by the User, or in the case of Usage Data, collected automatically when using this Site. Refer to our Cookie Policy for information on usage data.

We may collect personal data that you voluntarily provide to us when:

  • You request information about our services,
  • You submit questions to us,
  • You subscribe to our services; or
  • You choose to submit your resume in relation to career opportunities posted on our Site.

The personal data you provide may be used to communicate with you in connection with your various inquiries and subscriptions or to consider you for employment purposes, and will be kept for the time period in which it is necessary for the purpose it was collected.

Your personal data may be shared outside of the country where you are located, with relevant Praecipio Consulting affiliates in charge of dealing with your inquiries, subscriptions, or applications. When such transfers take place, Praecipio has implemented internal privacy policies and processes that ensure a high level of protection of your personal information, irrespective of where the personal information originates or is processed.

We may also share data provided by you with service providers that we retain to perform services on our behalf, such as third-party content providers that facilitate event registrations, support displaying Praecipio videos, and enable sharing of Praecipio content on social media. These providers are contractually limited from using or disclosing the data except as is necessary to provide services to us or to comply with legal requirements. Any sharing of personal information with third parties complies with applicable law, including CASL regulations. However, Praecipio does not own or control these third parties, and we are not responsible for privacy practices outside of our interaction with the third party specific to the business purpose. In addition, we may share personal information at your discretion, such as when you enroll in a webinar or pay for a Service. Furthermore, we may disclose data about you where we are required or permitted by law to do so.

Any use of Cookies – or of other tracking tools – by this Site or the owners of third-party services used by this Site serves the purpose of providing the Service requested by the User, in addition to any other purposes described in this Policy and in the Cookie Policy.

Types of personal information we collect when you communicate with us include:

  • Identifiers such as Real name, pronouns, alias, postal address, unique personal identifier, online identifier, Internet Protocol (IP) address, email address, SSN, Canadian SIN, Driver’s License, state, provincial, territorial, or federal ID, or other similar identifiers. Occasionally, when necessary for specific purposes, gender, date of birth, age, place of birth.

  • Commercial information such as history and records of the products and services you have obtained from Praecipio Consulting LLC. Correspondence between you and us when it is sent to a dedicated mailbox or via other electronic communication means, for the purpose of processing accounts receivable payments and commercial follow-up.

  • Marketing information, including: Identifiers – the IP address, social media handle, or other identifiers of a personal nature, including email address/mobile number if used for direct marketing, and name and address; demographic data – income, family status, age bracket, gender, interests, pets, home ownership, health, current service providers; browser/web history data and preferences expressed through selection/viewing/purchase of goods, services and content, information about your mobile device including (where available) type of device, device identification number, mobile operating system; social media content – blogs, posts, and anything posted by an individual online or which mentions/references an individual; analytics and profiles of the individuals based on the data collected on them; voice-enabled services (speech-to-text engines for search requests) without being recorded or stored by the mobile device.

  • Sensitive Data and Biometric Information, such as certain types of sensitive information when permitted by local law or with your consent, including health/medical information (including disability status/access requirements and dietary requirements/allergies in the framework of events we organize/sponsor) or biometric information, for example as when you elect to use fingerprint authentication.

  • Position and Professional or Employment-Related Information, such as description of current position, job title, employer, location, and Praecipio contact(s).

  • System and Application Access Data and Internet and Electronic Network Activity Information: Where you are provided with access to Praecipio’s systems, Praecipio may collect information required to access such Praecipio systems and applications such as System ID, LAN ID, email account, instant messaging account, mainframe ID, system passwords, and internet or other electronic network activity information, including access logs, activity logs, and electronic content produced using Praecipio systems.

We may also collect certain other information necessary to fulfill the Services that you have requested from us. We advise you not to share any sensitive personal information that you do not feel comfortable disclosing to strangers, such as information that relates to medical facts, racial or ethnic origins, political or religious beliefs, or sexuality. We may also collect and analyze information from the content of communications you have with us (including text messages and emails) using automated systems.

In addition, for recruitment/employment purposes and to provide assessment and HR consultancy services to our clients, Praecipio may process the personal information set out in the below table.

Additional personal details, contact details and identifiers/demographics.    

In addition to the personal details listed above, Praecipio may collect additional personal details for recruitment/employment purposes, such as national identification number, social security number, insurance information, marital/civil partnership status, domestic partners, dependents, emergency contact information, and military history; professional/personal calendar availability/scheduling information for meeting/communication purposes.

Education information and professional or employment-related information.    

Praecipio may collect information about your education and professional or employment-related information, such as your employment history.

Sensitive data for recruitment purposes or for providing assessment/HR consultancy services.    

Praecipio may collect certain types of sensitive information when permitted by local law or with your consent, such as health/medical information (including disability status), trade union membership information, religion, race or ethnicity, minority flag, and information on criminal convictions and offenses. Praecipio collects this information for specific purposes, such as health/medical information in order to accommodate a disability or illness (subject to legal limits on the timing of collection of such information and other applicable limitations) and to provide benefits; background checks and diversity-related personal information (such as race or ethnicity) in order to comply with legal obligations and internal policies relating to diversity and anti-discrimination.

Documentation required under immigration laws.    

Praecipio may collect data on citizenship, passport data, and details of residency or work permit (a physical copy and/or an electronic copy).

Financial information for payroll/benefits purposes    

Your banking and other relevant financial details we need for payroll/benefits purposes.

Talent management information.    

Information necessary to complete a background check, details on performance decisions and outcomes, performance feedback and warnings, e-learning/training programs, performance and development reviews (including information you provide when asking for/providing feedback, creating priorities, updating your input in relevant tools), driver’s license and car ownership information, and information used to populate biographies.

Requested recruitment information    

Information requested to provide during the recruitment process, to the extent allowed by applicable law.

Recruitment information you submit    

Information that you submit in résumés / CVs, letters, writing samples, or other written materials (including photographs).

Information generated by us during recruitment or during assessments    

Information generated by interviewers and recruiters related to you, based on their interactions with you or basic Internet searches where allowed under applicable law.

Recruitment information received from third parties    

Information related to you provided by third-party placement firms, recruiters, or job-search websites, clients where applicable.

Audiovisual information processed during recruitment    

Photograph, and images/audio/footage captured on CCTV or other video systems when visiting our offices or captured in the course of recruitment events or video recruitment interviews.

Recommendations

Recommendations related information provided on your behalf by others.

Immigration

Documentation and related information required under immigration laws.

Employment history and background checks    

Information about your prior employment, education, and where applicable and allowed by applicable law, credit history, criminal records or other information revealed during background screenings.

Diversity related information    

Information about race / ethnicity / religion / disability / gender and self-identified LGBT status, for purposes of government reporting where required by law, as well as to understand the diversity characteristics of the workforce, subject to legal limits and consent where applicable.

Assessment information     Information generated by your participation in psychological, technical or behavioral assessments. You will receive more information about the nature of such assessments before your participation in any of them.

We are committed to ensuring that our Site’s cookie usage complies with applicable U.S. and Canadian privacy laws. Our Security Measures to Protect Personal Data

We use industry-standard physical, technical, and administrative security measures and safeguards to protect the confidentiality and security of your personal information. However, since the Internet is not a 100% secure environment, we cannot guarantee, ensure, or warrant the security of any information you transmit to us. Although we use industry standard practices to protect your information stored on our servers, there is no guarantee that information, including sensitive personal information, may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. It is your responsibility to protect the security of your login information. You should never share this information with anyone and should always use strong, unique passwords.

It is important to note that while our Site is encrypted, email and other forms of communication are not. We advise you never to transmit personal information, especially sensitive personal information, via email. If you do communicate any confidential information, you are taking the risk that the information may not be secure. Praecipio will never ask you for this information via email, and we advise you to contact us if any such request is made by us or our affiliates.

No Information from Children Under Age 13

If you are under the age of 13, please do not attempt to provide any personal information about yourself to us. If we learn that we have collected personal information from a child under the age of 13, we will promptly delete that information. If you believe we have collected information about a child under 13, or are a parent or guardian of a child under 13 and believe we have collected personal information from that child, please contact us at info@praecipio.com.

How We Use and Share Your Information

We do not sell your personal information to third parties. We may, however, share your personal information if necessary to: (1) comply with federal, state, provincial, territorial, or local laws; (2) comply with a civil, criminal, or regulatory inquiry, investigation, subpoena, or summons by federal, state, provincial, territorial, or local authorities; (3) cooperate with law enforcement agencies concerning conduct or activity that we reasonably and in good faith believe may violate federal, state, provincial, territorial, or local laws; or (4) exercise or defend legal claims.

We may share non-personal information with other parties to provide and perform Services on our behalf or assist us in analyzing how our Services are used as long as the information has been anonymized or aggregated.

When Personal Information is shared with a third party, we will provide Users notice of this sharing and the right to opt-out where applicable. Furthermore, any third party will not further collect, use, or sell the Personal Information provided except as necessary to perform the business purpose for which it was collected.

Lastly, we may transfer to a third party Personal Information as an asset that is part of a merger, acquisition, bankruptcy, or other transaction in which the third party assumes control of all or part of our business.

As described above, we collect information from you so that we can provide products and services that you request and provide information that you request from us. We may use your Personal Information to:

  • Contact you about your service requests
  • Provide the services you requested
  • Personalize your experience
  • Improve our services
We may also use your information to send you information about products, services, and new offerings offered by us or by a partner of ours through email or through text messages to your mobile phone or other device. We may also contact you through email when new partners join us, our network and for new offers by us or our partners.

Third Party Access

We may provide information to third-party service providers that help us fulfill services that you request from us. We may also use third parties to help host our Site, send out email updates about the Site, sponsor conferences, provide marketing, analytic, and advertising services for us, remove repetitive information from our user lists, and process payments, possibly among other things. These service providers may have access to your personal information in order to provide these services, but when this occurs we implement reasonable contractual and technical protections to limit their use of that information to helping us provide the Service.

Feedback

Your feedback and suggestions you submit, including feedback or suggestions submitted through online forms, social media sites, or through email, will be considered non-confidential and non-proprietary. You hereby assign to us any and all rights in and to, and grant us a perpetual, fully paid, global, royalty-free, irrevocable right and license to use, all such ideas, suggestions, and feedback. We may use any of your feedback or suggestions to improve our services or for marketing purposes on our Site or on any of our social media sites without any obligation to you.

Statistical Analysis

We may use your information you provide to us through any medium (including emails you delegate us to process on your behalf), combined with other information we may obtain from other sources, to perform statistical, demographic, and marketing analyses of the users of our services, service requests patterns, to improve our understanding of our customers and potential customers, to improve our service, and to improve customer relationships.

Legal Proceedings

We will share personal information with third-party companies, organizations or individuals if we have a good-faith belief that access, use, preservation, or disclosure of the information is reasonably necessary to:

  • Meet any applicable law, regulation, subpoena, legal process, or enforceable governmental request
  • Enforce Our Terms of Use, including investigation of potential violations

Your Consent

In addition to the sharing described elsewhere in this Privacy Policy, we may share personal information with companies, organizations, or individuals outside of Praecipio in connection with events sponsored by us, and when we have your express consent to do so, including with persons chosen by you.

Transfer in the Event of a Sale or Change of Control

We do not sell, trade, or transfer your personally identifiable information to third parties, except as follows: If the ownership of all or substantially all of our business changes or we otherwise transfer assets relating to our business or the Site to a third party, such as by merger, acquisition, bankruptcy proceeding or otherwise, we may share, transfer, or sell your personal information to the new owner. In such a case your information would remain subject to the promises made in the Privacy Policy in effect at that time. In addition, if we acquire another entity, we may share your information with our new corporate affiliate.

Access to Your Information and Choices

If you would like to opt out of communications or have questions about personal information we have about you, or need to update your information, you can submit a data request form here. Options include requests to access personal data, delete it, or modify it. We will respond to your data request within 45 days from the date of receiving the request.

As stated on the Consumer Data Request Form, we require you to verify your identity by responding to a confirmation email sent by Praecipio Consulting LLC before we can fulfill any request regarding your personal data. In the event that an authorized agent is making the request on behalf of a consumer, necessary steps will be taken to verify that individual’s identity and confirm the validity of their authorized access.

While we are happy to provide you the categories of information we have regarding you, to protect the security of your information we cannot provide you with certain information you may have provided to us including, for example, passwords, credit card information, and other account numbers.  

Explicit Consent for Users in Canada

In compliance with Canada's Anti-Spam Legislation (CASL), we seek your explicit consent before processing your personal information for marketing purposes and other non-essential communications. By submitting any form on our website and checking the “I agree to receive other communications from Praecipio” box, you are providing explicit consent for us to use your personal information to send you Commercial Electronic Messages (CEMs), which may include marketing materials, newsletters, surveys, and any other non-essential communications that may be of interest to you. This explicit consent is obtained separately from our other data processing activities and specifically applies to these non-essential communications. Consent to receive other communications from Praecipio is not mandatory and can be revoked at any time.

You can withdraw your explicit consent for these communications at any time by using the unsubscribe link provided in our messages or by submitting a Consumer Data Request Form. Your explicit consent remains valid until you choose to withdraw it. Please note that withdrawing consent for these communications will not affect essential communications related to services you have requested, account notifications, or other legally required notifications.

Any CEMs sent in accordance with Canada Anti-Spam Legislation will include valid contact information as required by law, including company location, email address, and phone number. Messages will also include a method to request to be unsubscribed, which will be processed in accordance with applicable law, in no more than 45 days. Individuals can also submit a Data Request Form, which includes options to have personal information updated or deleted. Any changes made through this form will also apply to the data used for sending Commercial Electronic Messages (CEMs).

Database Opt-Out

If you prefer that we do not store any data on you, we have provided a procedure that allows you to remove any records of yourself currently and thereafter. In order to “opt out,” you can ask us to delete any records by simply submitting a Consumer Data Request with the selection “I would like to request all my personal data be deleted from the Praecipio database”. If you do so, please provide your name and email address, and we will use our best efforts to remove all records of you from our database. We may, however, retain a copy of the information for archival purposes, and to avoid identity theft or fraud.

Note that in order for us to process such requests, you will need to verify your identity by responding to a confirmation email sent by Praecipio Consulting LLC.

California Privacy Rights

Under California’s “Shine the Light” law, California residents who provide personal information in obtaining products or services for personal, family, or household use are entitled to request and obtain from us once-a-calendar-year information about the customer information we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year (e.g. requests made in 2023 will receive information regarding the sharing activities done in 2022).

To obtain this information, please fill out the Consumer Data Request Form with the selection “I would like to request a copy of the personal data Praecipio is storing about me”. We will provide the requested information to you at your e-mail address in response after you respond to the confirmation email sent to you. Please be aware that not all information sharing is covered by the “Shine the Light” requirements and only information on covered sharing will be included in our response. Pursuant to the California Consumer Privacy Act of 2018 (as amended by the California Privacy Rights Act of 2021) (“CCPA”), you have the right against discrimination for exercising your rights set out in the CCPA. You also have the right to receive notice of our practices at or before collection of personal information.

A copy of the CCPA will be provided to applicants, employees, and contractors upon request and before any personal information is collected about the individual.

Do Not Sell or Share My Personal Information

Under the California Consumer Privacy Act (CCPA), California residents have the right to opt-out of the sale of their personal information. We do not sell your personal information, and we do not share it with third parties for their direct marketing purposes. If you are a California resident and wish to confirm our compliance with CCPA regulations or request further information about how we handle your personal information, including opting out of any potential future sales, please contact us at info@praecipio.com.

Please note that we may still share your personal information with service providers for essential business purposes and to comply with legal obligations, even if you opt out of the sale of your personal information.

If at any time you wish to have your personal data deleted from our records or wish to make a change to or obtain a copy of your personal data stored by Praecipio, you may fill out the Consumer Data Request Form.

Consent to Data Processing in the United States

Our Site is operated and managed on servers located and operated within the United States. By using and accessing our Site, residents and citizens of countries and jurisdictions outside of the United States agree and consent to the transfer to and processing of personal information on servers located in the United States, and that the protection of such information may be different than required under the laws of your residence or location. 

United States privacy regulations require us to gain consent to process your personal information. Filling out a form on our Site is considered consent and applies to the purpose for which the information was collected. It will be considered valid until you choose to withdraw it, which you can do at any time by unsubscribing from our messages or submitting a Consumer Data Request Form. It is important to note that explicit consent is not required in the United States and therefore we do not seek out explicit consent when interacting with individuals we reasonably believe to be located in the United States.

Changes to Our Privacy Policy

In accordance with applicable law, we will update this privacy policy once a calendar year. We will not reduce your rights under this Privacy Policy without your consent in accordance with applicable law.  We will post any Privacy Policy changes on this page and, if the changes are significant, we will provide a more prominent notice (including, for certain services, email notification of privacy policy changes).

If we make changes to this Privacy Policy, we will revise the “Last Updated and Effective Date” at the top of this Policy.

In addition, we will take reasonable measures to notify Users of updates to this Policy on a periodic basis when we have the necessary contact information to do so.
